Terms of Service

These Terms of Service ("Terms") govern your use of the Flipebooks platform at flipebooks.com ("Service"), operated from Spain within the European Union. By creating an account or using the Service, you agree to these Terms.
1. Definitions
"We," "us," and "Flipebooks" refer to the operator of the Service. "You" refers to the individual or entity using the Service. "Content" refers to PDFs, flipbooks, images, text, and any other materials you upload or create. "Flipbook" refers to the interactive publication generated from your Content.
2. Account Terms
You must be at least 16 years old to use this Service (the minimum age for GDPR consent without parental authorization). You are responsible for maintaining the security of your account credentials. You must provide accurate and complete information when creating your account. One person or entity may not maintain more than one free account.
3. Acceptable Use
You agree not to:
- Upload content that infringes intellectual property rights
- Upload content that is illegal, harmful, threatening, abusive, or otherwise objectionable
- Use the Service to distribute malware or engage in phishing
- Attempt to gain unauthorized access to other accounts or systems
- Use the API in ways that exceed your plan's rate limits or abuse the Service
- Resell access to the Service without our written permission
- Use AI features to generate content that violates applicable laws
We reserve the right to suspend or terminate accounts that violate these terms.
4. Your Content
You retain all rights to Content you upload to the Service. By uploading Content, you grant us a limited license to process, store, and display it as necessary to provide the Service — including generating flipbook pages, extracting text, generating AI alt-text, and performing AI translations when you request them.
We do not claim ownership of your Content. We do not sell your Content to third parties. We do not use your Content to train AI models.
5. AI Processing
The Service uses AI models (via Vercel AI Gateway) to provide features such as alt-text generation, visual translation, chatbot responses, SEO metadata generation, and analytics insights. When you use these features, relevant portions of your Content are sent to AI providers for processing.
AI-generated content (alt-text, translations, chatbot responses, insights) is provided "as-is" and may contain errors. You are responsible for reviewing AI-generated content before publishing.
6. Payment and Billing
Paid plans are billed monthly or annually through Stripe. Prices are listed in USD. You can upgrade, downgrade, or cancel at any time from the billing dashboard. Downgrades take effect at the end of the current billing cycle. We calculate pro-rata credits for mid-cycle upgrades.
AI credit packs are one-time purchases that do not expire. Refunds for credit packs are available within 14 days of purchase if no credits have been consumed.
7. Intellectual Property
The Service, its design, code, and branding are owned by Flipebooks. These Terms do not grant you any rights to our trademarks, logos, or brand assets except as expressly provided (e.g., white-label plans remove our branding from your flipbooks).
8. Limitation of Liability
To the maximum extent permitted by law, Flipebooks shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
9. Service Availability
We aim for high availability but do not guarantee uninterrupted access. We may perform maintenance that temporarily affects the Service. We will make reasonable efforts to notify users of planned downtime.
10. Termination
You may close your account at any time from the settings page. We may suspend or terminate your account if you violate these Terms. Upon termination, your Content will be deleted within 30 days, except where retention is required by law.
11. Governing Law
These Terms are governed by the laws of Spain and the European Union. Any disputes shall be resolved in the courts of Spain, without prejudice to your rights under EU consumer protection regulations.
12. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via email or an in-app notice at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance.
